قوانین، مقررات و آسیب‌شناسی:
در كشور ما نيز در قوانين و مصوبات مختلفی بر لزوم شفاف‌سازی ابعاد مختلف قراردادهای دولتی تصریح شده
است. «آیين نامه نظام اطلاع رسانی عمومی قراردادها مورخ 1387/4/5 مصوب هيئت وزیران به استناد اصل 138
قانون اساسی و به عنوان آیيننامه مستقل، «آئين‌نامه اجرایی پایگاه اطلاعات قراردادهای كشور« مورخ 1392/2/29 مصوب هيئت‌وزیران موضوع بند (ب) ماده 3 قانون ارتقاء سلامت نظام اداری و مقابله با فساد مصوب1390 و «آیيننامه اجرایی نحوه اطلاع‌رسانی برگزاری مناقصات» موضوع «قانون برگزاری مناقصات» مصوب 1383 از جمله این مصوبات هستند.
آیيننامه نظام اطلاع‌رسانی عمومی قراردادها مصوب 1387/4/5 نخستين مصوبه در خصوص شفاف‌سازی قراردادهای دولتی در كشور بود كه متأسفانه در عمل تا زمان لغو آن در سال 1392 رعایت نشد.
آئين‌نامه اجرایی پایگاه اطلاعات قراردادهای كشور مصوب 1392/2/29 با لغو آئين‌نامه نظام اطلاع‌رسانی 1387/4/11 ثبت «متن قراردادهای مربوط به معامالت متوسط و بالاتر به روش مناقصه، مزایده، ترک تشریفات و غيره كه از سوی دستگاه متبوع منعقد شده و همچنين اسناد و ضمایم آنها و هرگونه الحاق، اصلاح، فسخ، ابطال و خاتمه قرارداد پيش از موعد و تغييرات آنها و نيز كليه پرداخت‌ها» را در پایگاه اطلاعات قراردادهای كشور الزامی دانست (ماده4) و اشخاص مشمول آئين‌نامه را بسيار موسع تعریف كرد (ماده6)
ماده 5 این مصوبه، صراحت آیيننامه سابق را از بين برده و در حکم كلی و مبهم اعلالم كرده است كه نحوه و
ميزان دسترسی افراد به اطلاعات قراردادها به شرح زیر خواهد بود : «عموم مردم، حسب مورد و سطح دسترسی
میتوانند به اطلاعات قراردادهای ثبت شده در پایگاه دسترسی داشته باشند». همچنين، قراردادهای متعددی را با
عبارت های مبهم از شمول آیيننامه استثنا كرده است. برای مثال، »قراردادهایی كه به موجب قوانين، افشای
اطلاعات آنها ممنوع می‌باشد» از شمول آیيننامه استثنا است؛ اما پرسش این است كه این قوانين و قراردادها
كدامند؟
متأسفانه این آیيننامه نيز، در عمل، رعایت نشده است.
الزام به انتشار اطلاعات راجع به برگزاری مناقصات برای عموم در «قانون برگزاری مناقصات» مصوب 1383 و نيز
ماده 3 قانون ارتقاء سالمت نظام اداری و مقابله با فساد پيشبينی شده است. آئين‌نامه اجرایی نظام مستندسازی و اطلاع‌رسانی مناقصات مصوب 1385 با هدف رقابت پذیر شدن برگزاری مناقصات و پيشگيری از تبانی در انجام
معامالت دولتی، روش‌های مختلفی را حسب نوع مناقصه (محدود و عمومی)، برای فراخوان و اطلاع‌رسانی در
خصوص مراحل مختلف مناقصات دولتی پيشبينی كرده است.
مادۀ 23« قانون برگزاری مناقصات» نيز دولت را موظف به ایجاد «بانک اطلاعات و پایگاه اطلاع رسانی مناقصات» كرده است تا نسبت به ثبت و نگهداری فراخوان مناقصات و اطلاعات مربوط به مناقصات اقدام نمایند.بر این مبنا معاونت برنامه ریزی و نظارت راهبردی ریاست جمهوری بر مبنای مادۀ فوق و آئين‌نامه اجرایی آن مصوب هيأت وزیران نسبت به ایجاد پایگاه مذكور اقدام نموده است.
متأسفانه پایگاه مذكور، اطلاعات مربوط به مناقصات را به طور دقيق و كامل ندارد و میتوان گفت كه این
آیين نامه نيز، در عمل، به طور كامل، رعایت نشده است.

Open contracting should go far beyond better open data to drive systemic reforms: giving citizens the nutritious school meals, the world-class medical equipment, and better goods and services that they deserve. It has become one of the key open data-driven initiatives in recent years.
That’s why we’re excited to be gearing up for the big arena at the International Open Data Conference in Buenos Aires later this month. We’ve planned an action-packed week of sessions and events to discuss how to use open contracting data to create lasting impact and challenge vested interests.
Make sure to sign up for our pre-event Open Contracting in Practice (organized with Hivos and ILDA) and our Happy Hour (with our friends at the OGP), both on Tuesday, September 25. Summary of the Principles
Transparency by design: Transparency should be the norm for all government contracts, particularly regarding information on what is being exchanged and for what price. Contracting systems should be designed to support proactive publication of contracts as open data.
- Public contracting should be designed for transparency and efficiency.
- Full contract publication should be the norm.
- Information needed to judge value for money should be disclosed.
Exceptions in the public interest: Redactions on the basis of commercial sensitivity should only be justified where the public interest in withholding information is greater than the public interest in having that information published. The assessment should take into account both any commercial harm to the contractor and the broader benefits of transparency to markets and public trust.
Where exceptions to publication are considered:
- Information should only be redacted for reasons of commercial sensitivity when the public interest in withholding information is greater than the public interest in disclosure.
- The public interest test should take into account the wider economic benefits of the sharing of commercial information, as well as the case for accountability and the public’s right to know.
- All redactions should be clearly marked with the reason for redaction.
A clear and robust process: Governments should issue detailed guidance on commercial sensitivity principles and exemptions, put in place systems to support publication, ensure that redaction is time-limited, and use other oversight mechanisms to compensate for information withheld from publication.
- Governments should issue clear guidance to public entities, agencies, and firms on contract publication and when information may be exempted from publication for commercial sensitivity reasons.
- Where redaction is potentially allowed, there should be a clear process for determining what is redacted, why, for how long, and with what appeals process.
- There should be a system for ensuring that contracts and contract information are in fact disclosed in practice.
- Where exemption to disclosure of information is granted for commercial sensitivity reasons, this should be grounds for increased scrutiny through other oversight mechanisms.

سامانه متمرکز خریدهای دولتی قزاقستان
Государственные закупки Республики Казахстанتوی قزاقستان، تمامی خریدهای دولتی باید از طریق یه سامانه متمرکز به آدرس goszakup.gov.kz انجام بشه
هر خریدی که با بودجه دولتی انجام میشه! (حتی مثلا خریدهای خُرد یه درمانگاه دورافتاده تو یه روستا)اولش شاید خیلی فانتزی و خیالی به نظر برسه، اما واقعیت اینه که انقدر این پروسه ساده‌ست، که همه ادارات و سازمان‌های دولتی و شعبات اون‌ها در سراسر کشور، به راحتی و بدون هیچ بروکراسی پیچیده‌ای، میتونن خریدهاشون رو از این طریق انجام بدن
طبق گزارش این سامانه، تو سال 2019 بیشتر از 16 میلیارد دلار (حدود 6.2 هزار میلیارد تنگه) خرید از طریق این سامانه انجام شده
هر روز هزاران درخواست ریز و درشت از سرتاسر کشور توی این سایت درج میشه و هزاران تأمین کننده (که از قبل لایسنس لازم رو گرفتن) بصورت آن‌لاین با هم رقابت میکنن
نتیجه نهایی هم بصورت کاملا شفاف برای همه مردم قابل مشاهده‌ست.کل این فرایند (ثبت آگهی خرید، اعلام قیمت توسط تأمین‌کننده‌ها و مشخص شدن برنده) خیلی وقت‌ها ظرف یکی دو روز انجام میشه.
بعد از مشخص شدن برنده، بلافاصله دو طرف قرارداد رو امضا میکنن (با استفاده از امضای الکترونیکی -ЭЦП - که اونجا خیلی رایجه) و مقدمات تحویل کالا یا ارائه خدمت منطبق با قرارداد اجرا میشه
حتی خیلی وقت‌ها ممکنه خریدار و فروشنده هیچوقت همدیگه رو نبینن!یکی از دوستان ما که چندسالیه داره تو این سامانه جنس میفروشه، میگفت بعضا ما صبح سیستم رو چک میکنیم، رو چندتا آگهی پیشنهاد قیمت میدیم و بعدازظهر همون روز، داریم جنس رو بارگیری میکنیم برا یه گوشه‌ی کشور؛ همینقدر ساده!
یک مثال!
مثلاً توی این آگهی یه اداره دولتی، آگهی درخواست خرید مقداری کاغذ A4 داده (با مشخصات دقیق کاغذی که میخواد)
همه شرکتهایی که لایسنس ورود به این سامانه رو به عنوان تأمین‌کننده‌ی این گروه کالایی دارن، میتونن با یه کلیک ساده روی این درخواست، وارد مناقصه بشن؛ که در مورد این آگهی 7 تا شرکت توی مناقصه شرکت کردناینجا میتونیم تمام پیشنهادهایی که برای این آگهی ثبت شده رو ببینیم؛ چه شرکتهایی، دقیقا در چه زمانی، چه قیمت‌هایی پیشنهاد دادن و آخرش کی برنده شده
مشخصات کامل شرکت تأمین‌کننده‌ای که برنده‌ی این آگهی شده رو هم اینجا میشه دید (توی قزاقستان فقط اگر اسم شرکت یا شماره ثبت -БИН اون رو داشته باشیم، خیلی راحت میشه تمام سوابق مالی و مالیاتی، پرونده‌های قضایی و حقوقی و کلی سوابق دیگه‌ی اون شرکت رو بدون هیچ محدودیتی بررسی کرد)قرارداد نهایی امضا شده بین دو طرف، جزئیات تراکنش‌های بانکی انجام شده بین خریدار و فروشنده و هر اطلاعات دیگه‌ای که میشه فکرش رو کرد توی این سامانه در دسترسه
شرکت‌های دیگه هم اگر، به هر دلیلی شکایتی نسبت به این خرید داشته باشن، توی همین سامانه شکایت‌شون رو ثبت میکنن و همه بازدید کننده‌ها میتونن تمام شکایت‌ها و نتیجه بررسی اون رو ببینن
خلاصه اینکه هیچ چیز پنهانی در این فرایند وجود نداره
و عملا اگر کسی بخواد با زد و بند کارش رو راه‌بندازه، خیلی باید فسفر بسوزونه!چند نکته تکمیلی:
این سامانه خیلی ریزه‌کاری و جذابیت داره
خصوصا انواع مختلف قراردادها و شیوه‌های مختلف خرید که توش تعریف کردن، خیلی جالب و البته پیچیده‌ست
من فقط خواستم به طور خیلی ساده، کلیت قضیه رو تعریف کرده باشم.تأمین‌کننده‌هایی که گواهی «Сделано в Казахстане» (تولید شده در قزاقستان) رو داشته باشن، در رقابت با بقیه تأمین‌کننده‌هایی که فقط واردکننده هستن، همیشه برنده میشن (فقط کافیه قیمت پیشنهادی‌شون، از قیمت پیشنهادی خریدار بیشتر نباشه)
من تا حالا ده‌ها ساعت توی این سامانه گشتم و هر بار، به کشفیات جدیدی رسیدم!
جدای از بحث مقابله با فساد، از نگاه مطالعه بازار هم خیلی اطلاعات خوبی میشه ازش بدست آورد.

Taming crocodiles, fighting corruption in Afghanistan
“If you have to live among the crocodiles, you’re going to have to tame them if you can,” says an Afghan anti-corruption campaigner when talking about the challenges of his work for our new story on efforts to open up the country’s public contracting. Amid war, entrenched corruption, weak institutions and power abuse, Afghanistan’s procurement market makes an attractive feeding ground for hungry predators.
But determined reformers are shining a light on this murky habitat: since 2014, the government has established the country’s first-ever public procurement agency, passed a world-class access to information law and published thousands of contracts on its new open contracting platform. Progress has been volatile and hard-won, but early results are promising, suggesting a total of AFN 58 billion (US$740 million) in savings in the past five years. All agencies are required to report to the new procurement portal and monitors from civil society say contracting documents are easier to come by too. 2020 is a big year for Europe as the Commission and member states lay out a coherent vision for the next five years. We think it’s time for the EU to move beyond relying on governments sharing basic notices about upcoming tenders to being a smart, integrated digital marketplace that fosters innovation and economic opportunity – a message we’ll be sharing in Brussels this week at the DG Regio’s high-level conference on engaging citizens for good governance. What’s happening in open contracting around the world

After a “long and painful data cleaning process”, the Spanish non-profit news outlet, Civio , has published a new investigation that reveals thousands of public contracts in Spain fail to comply with the law in order to avoid competitive tendering.
The teams behind Ukraine ’s innovative procurement and asset sales systems have been named one of Apolitical’s Global Public Service Teams of the Year in the category ‘Doing More with Less’.
Kyrgyzstan’s database disaster : A new investigation by the OCCRP and the media group Kloop shows how one official signed away millions in procurement contracts.
Together with the Engine Room, we created guidance on re-using open contracting tools and identifying the right open data tool to publish, analyze, visualize and work with government procurement data.
In an article discussing the biggest trends for open government this year, our executive director Gavin Hayman says: “We’ll see governments acknowledge that more openness is needed to tackle the credibility crisis of politics and to build countervailing power to overcome vested interests blocking change.”
The IACCM Innovation & Excellence Awards 2020 are now live. This year, we are collaborating with the IACCM on an award for “Open Contracting Impact.” The title is given to a public sector organization that has successfully implemented open contracting and can show how that transparency is demonstrably changing lives. We’ve built a new tool for assessing the quality of open contracting data called Pelican , which we’ll test in the coming months and integrate into our existing processes for giving feedback to publishers.
With the support of the UK Prosperity Fund, we’ve been working on a project in Colombia to empower regional governments to boost development and competition through public procurement. Read our 8 strategies for regional authorities to transform their contracting.
In Paraguay , the youth collective reAcción has published their fifth report monitoring the distribution of funds for school repairs in the city of Ciudad del Este. They found a massive improvement in how the money is allocated and documented how their work with school administrators and communities in recent years has made a difference.
Chile’s Observatorio Fiscal has published its second study on contracting in the health sector , along with recommendations for how to increase transparency and improve competition. They also scrutinized the ‘favorite suppliers’ of different administrations.
Our Latin America Program Manager Oscar Hernández wrote an opinion piece about putting outcome-oriented procurement strategies into practice, based on the government of Santiago’s experience reforming sanitation contracts.
Elsewhere in Latin America, Transparencia por Colombia has released a tool for comparing election campaign funders and government contractors , developed in collaboration with Datasketch.
The Government Transparency Institute has published a working paper measuring the benefits of open contracting reforms in Mexico, Paraguay and Slovakia .

وزارت دادگستری بریتانیا برای هندل‌کردن خریدها و تدارکاتش حرکت ساده اما جالبی انجام داده. یه برنامه‌ای به نام government procurement card policy تعریف کردن و با مشارکت جی.پی.مرگان یه سری کارت اعتباری در اختیار افراد قرار دادن. تقریبا میشه گفت نقش تنخواه‌گردانی رو ایفا میکنه. با این کار همه‌ی خریدها به صورت شفاف بدون نیاز به فاکتوربازی انجام میشه و به کمک سیستم اطلاعاتی دقیق و یکپارچه ضبط و منتشر میشه.
